Terms of Service

These Terms of Service (the "Terms") govern your access to and use of the websites, dashboards, APIs, and proxy services (collectively, the "Service") operated by ProxyTower ("ProxyTower", "we", "us"). By creating an account, signing in, or using the Service, you agree to these Terms and to our Acceptable Use Policy and Privacy Policy, which are incorporated by reference. If you do not agree, do not use the Service.
1. The Service
ProxyTower provides SOCKS5 proxy endpoints backed by real mobile devices on cellular carrier networks. Plans are sold for fixed durations (for example 24 hours, 7 days, or 30 days) and include the features described at purchase time, such as location selection and IP rotation. Carrier, IP address, and network characteristics vary by location and over time; no specific IP address, carrier, or network behavior is guaranteed.
2. Accounts
- You must be at least 18 years old and able to form a binding contract to use the Service.
- You must provide a valid email address and keep your password and proxy credentials confidential. You are responsible for all activity under your account and through your proxy endpoints.
- Creating an account by signing in constitutes acceptance of these Terms.
3. Payments, balance, and pricing
- We accept card payments (processed by Stripe; we never see your card number) and cryptocurrency payments in the currencies shown at checkout.
- Cryptocurrency invoices quote an exact amount at the current rate and are valid for the period shown. Payments are recognized after network confirmation. Overpayments within our tolerance are credited to your account balance.
- Your account balance is a prepaid service credit. It is not money, is not transferable, accrues no interest, and can only be used to purchase the Service. Balance does not expire.
- Prices are stated in USD and may change at any time for future purchases.
4. Refunds
- All sales are final. Refunds may be issued at our sole discretion, for example where we are unable to deliver the Service.
- Cryptocurrency payments are non-refundable once confirmed on the network.
- Where a refund is issued for a card payment, it reverses the corresponding wallet credit or purchase.
- Initiating a chargeback or payment dispute while continuing to use the Service is grounds for immediate suspension.
5. Acceptable use
Your use of the Service is subject to the Acceptable Use Policy. Violations may result in immediate suspension or termination without refund, and we may report unlawful activity to law enforcement where required.
6. Service availability
- The Service is provided without an uptime guarantee or service level agreement. Mobile networks, device hardware, and carrier behavior are inherently variable.
- We may perform maintenance, rotate hardware, change available locations, or modify features at any time.
- IP rotation and relocation are provided on a best-effort basis.
7. Suspension and termination
We may suspend or terminate your account at any time for violation of these Terms or the Acceptable Use Policy, for non-payment, for payment disputes, or where required by law. You may stop using the Service at any time. Sections 3, 4, and 8 through 11 survive termination.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SUITABLE FOR ANY PARTICULAR USE.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROXYTOWER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR BUSINESS, ARISING FROM OR RELATED TO THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNTS YOU PAID US IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
10. Indemnification
You will indemnify and hold harmless ProxyTower and its operators from claims, damages, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any law or third-party right.
11. Governing law and disputes
These Terms are governed by the laws of the state in which ProxyTower's operator maintains its principal place of business, without regard to conflict-of-law rules. Disputes will be resolved in the courts of that state, and you consent to their jurisdiction.
12. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date above reflects the current version. Continued use of the Service after changes take effect constitutes acceptance.
